Who issues an Apostille?

Each signatory nation can designate which authorities may issue an Apostille for their jurisdiction.

The United States has designated the Secretary of State (or equivalent) of the various states as that authority.

The Secretary of State of Texas has extended this authorization to include the Assistant Secretary of State and the heads of the divisions.

The Texas Secretary of State may issue an Apostille for documents issued by different offices within the state, including county clerks, notaries public and officers statewide.

Birth or death certificates recently issued by local registrars must have been issued within the last three (3) years for the Secretary of State to issue an Apostille.

For federal documents, the federal court secretaries are authorized to issue Apostilles.
